What to Do If You Suspect Someone Is Using Your Copyright or Trademark without Your Permission

While no one ever wants to think that another party would take his or her copyright or trademark, it happens! A copyright or trademark owner should have a plan in place should in the event of discovering unauthorized use of his or her valuable asset.

1.      Remain calm. If possible, do not take direct action right away. Also, do not make a decision regarding “letting it go” or “going to get ’em” until you complete all the steps listed below. If possible, go directly to Step 2. While it may be extremely upsetting, preserving evidence and taking notes will help you in the long run to create a long-term solution to preventing the infringement from happening again. Acting quickly could also create additional problems for you if you act hastily, do not have the rights you believe you have, or interfere with a person’s business.
